Overview

We at Feels, LLC, a Louisiana limited liability company, (alternately, the “Company”, “we”, “us” or “our”) respect your privacy and your privacy is of the utmost important to us. This privacy policy (“Privacy Policy”) describes what information we collect about you, including how we collect it, how we use it, with whom we may share it and what choices you have regarding our use of your information. 

This Privacy Policy applies to information collected on our mobile application and our website, which is located at www.givefeels.com (collectively or individually referred to herein as the “Application”), information that we collect from our business partners and other offerings that post a link to this Privacy Policy, or any associated content, material, or service contained on the Application (collectively, the “Services” and, together with the Application, the “System”). This Privacy Policy is not intended to and does not create any contractual or other legal right in or on behalf of any party. 

By accessing the System, you are agreeing that you have read, understood, and consent to the Privacy Policy and all other rules of the Company with respect to the System. Further, if you are accessing the System on behalf of an entity, you are: (i) representing and warranting that you have the authority to bind such entity to the Privacy Policy; and, (ii) you are agreeing to the Privacy Policy on behalf of such entity, and that the entity understands and consents to the Privacy Policy. If you disagree with any provisions of this Privacy Policy, please do not use the System. 

What Information Do We Collect?

The Company collects information about you from a variety of sources, including information that you provide directly to us, when you contact us, sign-up for a customer account, and make donations on the Application or otherwise interact with the Application, and information that we automatically collect about you when you access and use the Application. The information may be stored on our servers, and on the servers of our third party service providers. We collect certain information, including without limitation the following: contact data and information; account credentials; profile information such as interests, favorites and preferences; content of messages that you send us; device connectivity; social media usernames and handles; and, location data (device’s location can be precise or imprecise) via global positioning system. 

Information You Provide Us.

If you sign-up for a customer account, make donations, or contact us through the Application, we and/or our service providers collect the requested information that you provide including your name, e-mail, phone number, address(es), and payment information. The information that you provide may include Personal Information which identifies you personally. If you purchase anything through the Application or make any donations, you may be required to provide financial information to third party processors, with whom we have a relationship. We do not collect or store any financial information that you provide to such third party payment processors and we are not responsible for the collection or storage of such information by third parties. We may have certain information relating to your account, including any funds in your accounts maintained by us. 

Further, as described below, if you participate in any polls, surveys or other interactions with the System, we may collect certain information and content from you, which information provided by you will be purely optional. 

Information Collected Automatically.

We collect information automatically from you when you visit the Application and use the System. Such information includes the following: 

Usage information. We collect information about how you interact with the Application. This includes information such as the dates and times that you visit the Application, the pages you view, referring/exit links, your browser type/operating system and your geolocation information. In some cases, we collect this information through cookies, web beacons, and similar technologies. To learn more about these technologies, please see the Cookies section below. We may also collect information about the devices you use to access the Application, including your device model, IP address, operating system, unique device identifiers, and mobile network operator information. 

Transaction Information. We collect transaction details related to your donations and purchases through the Application. 

Cookies

By placing a small file known as a "cookie" on your device, the Company’s and its third party providers’ servers passively gather information about all visitors' use of the System for the following purposes: statistics collection and analysis, System optimization, analytics, market research, and maintenance of user login information. The information that we and our third party providers track with cookies includes, but is not limited to, the type of browser and Internet-connected devices being used to access the System, your Internet protocol (“IP”) address, your home domain or Internet service provider, your referrer URL (which is the URL for the website that you were viewing prior to visiting the System), how you were directed to the System, which specific pages you access on the System, how long you view each page, the time and date you access our System and the total number of visitors to the System and any portions thereof. We, and/or our third party providers, may use the information collected from cookies or similar files on your computer for security purposes (such as authentication), to facilitate site navigation and to personalize your experience while visiting the System. This data helps us and our third party providers improve our respective product and services. By rejecting cookies, your use of the Application may be limited. If any of our third party vendors use cookies, we have no control or access over these cookies. 

Google Analytics

The System may use Google Analytics, a web analysis service provided by Google, in order to better understand your use of our System and how we can improve it. Google Analytics collects information such as how often users visit a website, what pages you visit when you do so, and what other websites you used prior to coming to such website. Google Analytics collects only the IP address assigned to you on the date you visit a website, rather than your name or other identifying information. We do not combine the information collected through the use of Google Analytics with your personal information. Although Google Analytics plants a permanent cookie on your web browser to identify you as a unique user the next time you visit a website, the cookie cannot be used by anyone but Google. Google’s ability to use and share information collected by Google Analytics about your visits to the Application is restricted by the Google Analytics Terms of Use and the Google Privacy Policy. Google utilizes the data collected to track and examine the use of the Website, to prepare reports on its activities and share them with other Google services. Social Media Features

Our Application may include social media features, which may use or include tracking technologies to collect information about you, such as your IP Address and other info. If you use social media features, information that you post or profile access to may be publicly displayed on our Application or otherwise by the social media platform (which is governed by its own privacy policy and terms/conditions). Social media features are operated by a social network which is a separate entity and which is governed by its own terms/conditions. We are not responsible for, and make no representations or warranties, regarding the policies or business practices of any separate entities and you should consult the social network’s privacy policies and terms/conditions. 

Please note that any information which you use on any chat room, commenting feature, or other forum through the System may include Personal Information that you disclose, which may be visible to other users on the System. This information may be ready, used and collected by others to send you certain unsolicited messages. While other users must agree to the Terms of Service and the Privacy Policy, we are not responsible for the manner in which your Personal Information that you decide to share publicly will be used by other users. 

Third Parties

In addition to the social media features and Google Analytics mentioned above, we may allow other third parties to place and read their own cookies, web beacons and other technologies to collect information through the System. The information collected and stored by third parties remains subject to their privacy policies, general policies and practices. We do not control or operate those third parties’ tracking technologies and how they are used. 

In addition to the third party providers mentions above, we currently use the services of the following third party vendors within the System and may share certain information with them to complete your transaction; therefore, you should review the privacy policies and terms and conditions of these third party vendors prior to using the System (for your convenience, we have included the link to the relevant privacy policies):

For clarification purposes, the System may contain links to websites, online services or other applications, which are not operated by us and which are not governed by the Privacy Policy or our Terms of Use. Further, these third parties are not, in any way endorsed by us. PLEASE REVIEW THE PRIVACY POLICIES AND OPT-OUT CAPABILITIES/REQUIREMENTS OF ALL THIRD PARTY WEBSITES, SERVICES OR APPLICATIONS.

We appreciate your questions and comments about the System and welcome your messages at hi@givefeels.com. If you correspond with hi@givefeels.com the personal information that we collect may include the content of, and metadata regarding, any correspondence you may have with us. 

How Do We Use The Information That We Collect?

The Company and our third party service providers collect and use the personal information to operate the System and deliver the Services, including to (i) provide certain services and improve the user experience, (ii) address System integrity or security issues, (iii) conduct research and analysis, (iv) maintain, protect, develop, and improve the System, (v) understand and analyze the usage trends, (vi) develop new products, services, features and functionality, (vii) contact you for administrative purposes, including customer service, (viii) personalize our services for you, and (ix) provide you with customized advertisements, content and information. 

We may also use your personal information to send you promotional materials, whether through email, text message or through the System, regarding the Company, charities that we think might interest you (whether location-based on preference-based), products that you might be interested in, resolving outstanding problems, responding to inquiries, and improving your overall experience with the System. We will only send you information via text message if you opt into receiving messages from the Company via text message. 

In addition to the uses mentioned or described elsewhere in this Privacy Policy, we may add your personal information to our databases. 

Text Messages

By consenting to the Company’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of the Company through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders). 

You understand that you do not have to sign up to receive SMS/text messages in order to make any purchases, and your consent is not a condition of any purchase with the Company. Your participation in this program is completely voluntary. 

We do not charge for the SMS/text messaging service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider. 

You may opt-out of the SMS/text messaging service at any time. Text the single keyword command STOP to +18556490932 or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Company mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the SMS/text messaging service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages. 

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number. 

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or SMS/text messaging service. 

With Whom Do We Share Information That We Collect?

For any donations that you make through our Application, we will share some of your personal information with third party payment processors in order to process your requested transaction. 

We engage service providers who may collect or receive your personal information on our behalf. Such service providers perform functions such as operating and supporting the Service, analyzing data, or performing marketing or consulting services. 

As the Company grows and develops, it is possible that its corporate structure or organization might change or that it might merge or otherwise combine with, or that it or portions of its business might be acquired by, another company. In any such transactions, personal information generally is, and should be expected to be, one of the transferred business assets. We may share aggregate (non-personally identifiable) information with certain third parties such as advertisers, national industry organizations, and prospective affiliates. 

We may disclose certain information to third parties in order to protect the legal rights, safety and security of the Company and the users of the System, enforce the Terms of Service and this Privacy Policy, prevent fraud, and comply with (or respond to) law enforcement or a legal process or a request for cooperation by a government or other entity, whether or not legally required. 

We may also share your information about you with third parties when you consent to such sharing. 

Sweepstakes, Promotions, Contests & Surveys

We may offer certain online polls, surveys, contests, sweepstakes and other promotions that may be offered from time to time by us, a partner, or other entity through which you are using the System. Participation in these polls, surveys, contests, sweepstakes and promotions is completely voluntary; you have a choice about whether or not to disclose information required to enter. Information requested may include personal information such as your name, address, date of birth, phone number, mobile phone number, e-mail address, username, and/or similar information. Subject to applicable legal restrictions, we also may use the information to communicate with you, or the other people you select, about our services or products. 

What Choices Do You Have?

When submitting information, corresponding, making requests for information, and otherwise interacting with the Company and its representatives through or in connection with the System, you generally choose what information to supply or submit, whether you wish to receive further information, and how you may be contacted. Please take care to share only such information as is needed or that you believe is appropriate. Any promotional email we send to you will contain a link which will allow you to opt-out of receiving any further correspondence. 

Can I Opt-Out of Promotional Correspondance?

We may send you emails with promotional offers. If you would no longer like to receive information, newsletters or other promotional messages from us, please click the link at the bottom of any such email you receive from us and follow the instructions. Your email address will be removed from our marketing list. Please allow us a reasonable period of time in order to satisfy your request, as some promotions may already be in process. Any “opt-out” procedures with respect to third party communications will be governed by the applicable third party. 

How Do We Protect Information Collected About You?

The Company takes commercially reasonable measures to secure and protect information transmitted via or stored on the System. Nevertheless, no security system is impenetrable. We cannot guarantee that information that users of the System may happen to transmit or otherwise supply will be totally secure. In the event of an inadvertent disclosure of your personal information we will take commercially reasonable steps to limit and remedy the disclosure as required by applicable law. We will retain any such information about you for the period necessary to perform the Services hereunder and for the purposes set forth herein, unless a longer retention period is required by law. 

Linked Websites

For your convenience, some hyperlinks may be posted on the System that link to other websites not under our control. We are not responsible for, and this Privacy Policy does not apply to, the privacy practices of those sites or of any companies that we do not own or control. We cannot be responsible for the privacy practices of any such websites or pages not under our control and we do not endorse any of these websites or pages, the services or products described or offered on such sites or pages, or any of the content contained on those sites or pages. We encourage you to seek out and read the privacy policy of each website that you visit. In addition, should you happen to initiate a transaction on a website that our System links to, even if you reached that site through the System, the information that you submit to complete that transaction becomes subject to the privacy practices of the operator of that linked website. You should read that website's privacy policies to understand how personal information that is collected about you is used and protected. 

Children

The System is intended for a general audience and is not intended for use or view by children under 13 years of age, and we do not knowingly collect information about children or sell products to children. Consistent with the Children's Online Privacy Protection Act, we will not knowingly collect any information from children under the age of 13. 

California Residents' Privacy Rights

This portion of our Privacy Policy advises California residents of rights provided in the California Consumer Privacy Act (the “CCPA”) and how to effectuate those rights. You may also authorize an agent to make such a request. We will seek to verify your identity when we receive an individual rights request from you in order to ensure the security of your personal information.

California residents have the right to request the deletion of personal information, but we may not delete some or all requested personal information as required or allowed by applicable law. California residents may also request to receive details about how we collect, use, and share your personal information. You may also request to receive the specific pieces of personal information that we have collected about you. 

We do not, and do not intend to, sell personal information and do not discriminate against you for exercising any CCPA rights, such as the access and deletion rights described above. If we choose to offer a product enhancement or financial incentive that is contingent on you sharing personal information, we will ensure that the value provided to us by that collection is reasonably related to the value of the product enhancement or financial incentive. 

Do Not Track Requests

Certain state laws require that we indicate whether we honor “Do Not Track” settings in your browser. We adhere to the standards set out in this Privacy Policy and do not monitor or follow any Do Not Track browser requests. 

Changes To Our Privacy Policy

We may change this Privacy Policy at any time and from time to time. All such updates and amendments are effective immediately upon notice thereof, which we may give by any means, including, but not limited to, by posting a revised version of this Privacy Policy or other notice on the Website.

Governing Law

This Privacy Policy is governed by the laws of the State of Louisiana, without giving effect to any conflict of law principles. 

International Users

By accessing the System, you acknowledge that the System is intended for use by users located in the United States of America. The Company makes no representation that the System is appropriate or will be available for use in other locations. By accessing the System from outside of the United Sates of America, you acknowledge and agree that your information may be transferred to and maintained on computers and services located outside of your country where the privacy laws may not be as protective as those in your country. Your consent to the Privacy Policy and use of the System represents your agreement to the transfer of such information to the United States and the collection, use and disclosure of your information in accordance with the laws of the United States of America and this Privacy Policy.
